Privacy policy
I. CONTROLLER
NOGUERA ABOGADOS, with registered office at Avenida de la Victoria, 80 B, 28023 Madrid (España), controls the processing of the data that are collected or generated as a result of users accessing, using and browsing the Website (the “Users”).
The purpose of this Privacy Policy is to provide information on your rights under the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
II. PURPOSES
In addition to managing the requests for information, content or services that Users expressly make or to which they consent, NOGUERA ABOGADOS has a legitimate interest in using the data that are collected or generated in order to:
- Improve the Website, its management and its security;
- Conduct studies to analyse the relevance and use of the Website, including by way of anonymized information; and
- Inform Users regarding legal current affairs via publications and other initiatives, when permitted under the applicable law.
III. COMMUNICATIONS
Data will not be disclosed to third parties except, where applicable, to competent public authorities in the exercise of their functions.
NOGUERA ABOGADOS may provide services abroad that may entail data transfers, some of which may be to countries that do not afford a level of data protection equivalent to that within the EU.
In addition, in the event any of our IT systems providers are located outside of the EU, NOGUERA ABOGADOS will adopt all the necessary safeguards in accordance with the law to ensure proper data management.
IV. LEGAL BASIS AND RETENTION
The legal bases upon which NOGUERA ABOGADOS is permitted to process the data of Users are:
- Users voluntarily accessing and browsing the Website;
- Users requesting information or certain content or services;
- NOGUERA ABOGADOS complying with its legal obligations;
- NOGUERA ABOGADOS’ legitimate interest in improving the Website and its security, and in conducting studies and analyses regarding the operation and use of the Website; and
- NOGUERA ABOGADOS sending information and news on legal current affairs to Users who have given their consent to the same or when it is in NOGUERA ABOGADOS’ legitimate interest to do so.
Data will be retained for as long as there are contractual obligations deriving from services or content requested by Users and subsequently until the expiration of legal, contractual or professional responsibilities that require they be stored (e.g. until the expiration of responsibility deriving from data protection or cybersecurity regulations).
In the case of data that are processed in order to send information regarding legal current affairs, they may be stored as long as Users do not object to receiving information via any of the various free-of-charge and straightforward means that are made available to them for doing so.
V. RIGHTS OF USERS
You may exercise the following rights:
- Right of access to your personal data to know which data are being processed and the processing operations that are being performed with that data;
- Right to rectification of any inaccurate data;
- Right to erasure of your personal data, where possible;
- Right to request the restriction of the processing of your personal data where the accuracy, legality or need to process the data is doubtful, in which case we may store your data for the exercise or defence of claims;
- Right to data portability, when the legal basis that enables us to process them is the contractual relationship or your consent;
- Right to object to the processing of your personal data, when the legal basis that enables us to process them is legitimate interest. For such purposes, we will cease to process your data unless we have a compelling legitimate interest or it is for the establishment, exercise or defence of legal claims;
- Right to withdraw your consent at any time.
